上海闵行区一个600多户的居民小区里，400多户人家都出现了房屋质量问题。为了自己的合法权益，小区业主们走上了一条艰辛的维权之路。3年了，至今没有盼到满意的结局。

　　
    2001年，姚瑞勤花了80多万元在这个名为“君临天下花园”的小区买了一套三层楼别墅，又花了30多万元装修，不料住进去不到半年，就发现家里卫生间瓷砖开始出现断裂，卧室里承重墙、地下室墙壁等处也先后出现了穿墙裂缝，最宽的裂缝可放进两枚硬币，令人触目惊心。甚至夜深人静的时候，有时都能听见毛骨悚然的墙壁开裂声。
    曾经在建筑行业工作过的姚瑞勤意识到问题的严重性，多次找房产开发商上海玖玖房地产发展有限公司交涉，工作人员不但矢口否认，还多次威胁他“不要鸡蛋碰石头，否则会死得很难看！”
    姚瑞勤的遭遇绝非个别，同一个小区的业主谢国平、顾文英、薛晌午等人也都有过类似经历。共同的遭遇使他们4人联起手来，在小区进行了一次房屋质量问题的调查。结果令人吃惊：小区673户居民中，至少有450户反映存在不同程度的质量问题！

在小区居民所反映的问题中，不仅普遍存在基础结构断裂、地下室漏水、渗水、承重墙体断裂等质量问题，在配套设施方面也存在欺诈行为。开发商卖房时曾书面承诺，门、窗、中央空调、热水器等和样板房完全一致，但有的业主住进去以后才发现，门窗材料廉价，中央空调的保温层，由样板房的橡塑保温材料变成了对人体有害的玻璃纤维材料。
尤为令人吃惊的是，小区一幢多层住宅楼里的杨先生在装修时，稍不小心就将楼下的天花板打穿了，这时才意外发现楼板厚度只有7．2厘米，比设计的厚度至少薄了2．8厘米，比国家规定的误差标准高出近十倍。

    调查结果出来以后，小区居民自发地召开了一次200多人参加的业主大会，大家纷纷要求“敢于出头”的姚瑞勤等4人作为代表向房产商讨回公道。2002年10月28日，姚瑞勤等人向出具小区《房屋质量验收合格证》的闵行区房屋质量监督站投诉，之后又多次到闵行区信访办反映情况，与此同时，还给上海市人大信访办、消费者协会、工商局、建委、反贪局等多个部门发去人民来信，均没有得到令人满意的答复。
    在万般无奈的情况下，姚瑞勤等人想到了直接给上海市有关领导写信，结果很快有了回音。闵行区信访办、消协、当地的颛桥镇信访办、居委会、玖玖公司、业委会、物业公司、业主代表、以及闵行区房屋质量监督站负责小区工程验收的工程师共同召开了一次会议，会上成立了工作小组，玖玖公司承诺在小区设立“房屋质量跟踪办公室”，专门负责处理这件事。
    但小区居民很快发现，房产开发商所谓的“修复”只是找几个泥水工人将房屋的裂缝补一补、刷一刷，而没有从根本上解决裂缝的问题。在业主的强烈要求下，2003年春节以后各方代表又开了一次会，会上决定找一家有资质的权威机构对小区房屋质量进行检测。

      经委托，上海市建筑科学研究院房屋质量检测站对姚瑞勤等4户房屋进行了检测，结论认为“4户居室均存在一定的质量问题”，“各类裂缝是目前住宅工程常见的质量通病，不影响安全结构，但对正常使用会造成一定影响，主要是容易引发外墙和楼板渗漏，因此应进行整改维修。”，检测报告最后还列出了详细的维修建议。
    针对上海市建科院的检测报告，玖玖公司列出了修理和补偿方案。但由谁修复、如何修复、以及是否要进行赔偿等问题上，双方又僵持不下。玖玖公司迟迟也没有实质性动作，无奈，薛晌午等人只好又三天两头到闵行区房屋质量监督站上访，请他们出面敦促解决，但站方工作人员根本不管。
    在无计可施的情况下，姚瑞勤等人再次想到给上海市有关领导人写信，很快，闵行区信访办又组织多方召开了一次会议，玖玖公司提出了房屋质量问题的七点处理方案。不料此后几个多月内，这份七点方案被束之高阁。在多次催促下，玖玖公司终于请了一家评估公司先评估损失。评估报告出来以后，业主们认为有失公正。又在区信访办的召集下，双方开会决定请一家维修公司进行修复，目前仍然在等维修方案出台……
    回顾近3年的维权之路，姚瑞勤等人感慨万千。且不说工作之余花费了大量的时间和精力，连人身安全也受到了威胁。向当地媒体反映房屋楼板薄的杨先生，家里曾经来过两个不速之客，警告他“别闹了，再闹下去我们拿不到工资，就在你家里吃、家里住”；薛晌午曾经接到过陌生人电话，要求到他公司里“谈谈、看看”；从日本回国的顾文英同样也接到过陌生人电话，“关切”地“提醒”她是不是有一个日本籍的儿子，在什么地方上学等等。

“作为普通的老百姓，我们始终感到最为困惑的是，像这样的房屋质量是如何通过国家有关部门验收的？”姚瑞勤愤慨地说：“我们用大半生的积蓄来买房子，本想安居乐业，谁曾想被这种窝囊事折磨得心力交瘁！”
据上海市消费者权益保障委员会统计，上海去年共接受4000多件房屋及装饰材料方面的投诉，比2002年增长28．87％。姚瑞勤等人所经历的种种维权艰辛，只不过是这些消费者中一个典型代表。
